Proposed Plan Variation 1: Miscellaneous Matters (Including Land rezoning) and Update and Alignment of Greenbelt Residential Zone

Proposed Plan Variation 1 (PPV1) involved changes to the Proposed District Plan (Decision Version). It sought to improve the clarity and consistency of the District Plan by introducing a number of consequential minor and specific rule and zone amendments to the plan that:

  • Align relevant provisions contained in parts of the District Plan that were subject to Plan Changes 20-22 with those that apply to other zone chapters in the plan;
  • Make minor corrections to the District Plan to assist with interpretation and application of provisions; and
  • Respond to resource management issues that have arisen since the District Plan Review process commenced in 2011.

The intent of PPV1 was not to alter or challenge the direction of the District Plan, but to improve the overall consistency of provisions across zones, resolve minor discrepancies and interpretation matters and re-zone a number of individual properties. The changes made to chapter 18 (Greenbelt Residential Rules) were relatively comprehensive in nature to ensure consistency. Otherwise, the changes were limited to minor wording amendments or property re-zoning, with no changes to the issues, objectives or policies in the District Plan.

Status The appeal that was made to the Environment Court on the decision for Proposed Plan Variation 1 was resolved and this proposed plan variation was made operative on 11 December 2015.

Operative Date

At its meeting on 2 December 2015, Horowhenua District Council authorised for Proposed Plan Variation 1 to be made operative from 11 December 2015.

In accordance with the requirements of clause 20(2) of the Resource Management Act 1991 the operative date for this proposed plan variation was publicly notified on 4 December 2015.

Proposed Plan Variation 1 resulted in a number of Chapters in the District Plan being amended including Chapters 17, 18, 19, 21 and 26. This proposed plan variation also resulted in the Gladstone Greenbelt Structure Plan being inserted in to Schedule 8 as well as several site specific zone changes. Notification of Decision and information on the Appeal period

Following the Hearing of submissions for this proposed plan variation the District Plan Hearings Panel (acting with full delegated authority) made a decision on Proposed Plan Variation 1.

The decision of the Hearings Panel was adopted for public notification by Council at its meeting on 3 June 2015. This decision was publically notified on 12 June 2015 and letters were sent to submitters informing them of the decision.

An appeal was lodged with the Environment Court on the decision for Proposed Plan Variation 1, following the public notification of the decision. Two other parties joined the appeal as section 274 parties under the Resource Management Act 1991.

The appeal related to the Gladstone Greenbelt Structure Plan which was proposed to be introduced into the District Plan as part of Proposed Plan Variation 1. This appeal was resolved via Environment Court mediation.

Hearing

Submissions on Proposed Plan Variation 1 closed on 15 September 2014, with 27 submissions received.
