Public Notification Proposed Plan Changes 22 and 23

PUBLIC NOTICE UNDER THE FIRST SCHEDULE OF THE RESOURCE MANAGEMENT ACT 1991

1. Proposed Plan Change 22: Outstanding Natural Features and Landscapes.
2. Proposed Plan Change 23: Financial Contributions.

Notice is hereby given that the Horowhenua District Council has approved two Proposed Plan Changes (22 and 23) for public notification and submissions.
Any submission on either of the plan changes must be received by the Horowhenua District Council before 5:00pm on 23 October 2009 in the required format. Submission forms are available on the Council’s website or from Council offices and libraries.
The two changes will amend the Horowhenua District Plan as follows:

1 Plan Change 22: Outstanding Natural Features and Landscapes.
Plan Change 22 seeks to identify and protect Outstanding Natural Features, Outstanding Natural Landscapes and High Amenity Landscapes within the Horowhenua district. Through new policies and rules, the proposed Plan Change, would create restrictions on how the land within the identified areas can be used and developed, particularly in relation to new buildings, structures, earthworks and network utilities.

The Plan Change includes amendments to the following parts of the District Plan: • Section 3 - Issues, Objectives: Natural Features and Values
• Section 19 - Rules: Rural Zone
• Section 22 – Rules: Network Utilities
• Section 24A - Assessment Criteria
• Section 25 – General Provisions: Definitions
• Schedule 4 – Outstanding Landscapes and Natural Features
• Planning Maps – Maps 32 and 33

2 Plan Change 23: Financial Contributions.
Plan Change 23 seeks to remove the existing references to financial contributions from the District Plan together with other minor or consequential amendments.
This change is designed to bring consistency between the Financial Contribution and Development Contribution Policies within the Long Term Council Community Plan 2009-2019, and the Operative District Plan.

Plan Change 23 would involve changes to the following parts of the District Plan:
• Rules 14.2.15, 15.2.15, 16.2.13, 17.2.13, 18.2.13 & 19.2.10
• Section 20 Rules: Subdivision and Development

Submissions:
Submission forms can be obtained from the above locations, or from the Council website. Any person may make a submission/s on these Proposed Plan Changes. You may do so by sending a written submission to, the Chief Executive Officer, Horowhenua District Council, Private Bag 4002, Levin 5540.

The submission must be in Form 5 of the Resource Management (Forms, Fees and Procedure) Regulations 2003 or similar, and must state whether or not you wish to be heard on your submission.

Submissions close at 5:00pm on 23 October 2009.

The Council Planning staff can provide you with additional information on making a submission and the Plan change process. Further general information about the District Plan Change process is also available from the Ministry for the Environment (www.mfe.govt.nz/rma/public/plans/index.html).

Process:
The process for public participation in the consideration of the proposed plan change under the Resource Management Act as follows:
• After the closing date for submissions, the Council will prepare a summary of the submissions and this must be publicly notified; and
• There will be an opportunity to make further submissions in support or opposition to the submissions already made; and
• If a person making a submission asks to be heard in support of their submission, a hearing must be held; and
• The Council will give its decision on the Proposed Plan Change (including its reasons for accepting or rejecting submissions); and
• Any person who has made a submission has the right to appeal the decision on the Proposed Plan Change to the Environment Court.
